Background
The 1973 Michigan Auto No-Fault Insurance Act (MCL 500.3101, et seq) guaranteed lifelong medical and rehabilitative care after catastrophic motor vehicle accidents. In 2019, despite strong opposition, Michigan’s governor and legislature made devastating changes to the law by signing Public Acts 21 and 22. This included a severe cut in attendant care hours which quickly had life-altering effects. In 2019, a lawsuit was filed on behalf of two Michigan citizens. The lawsuit, (Andary vs.USAA Casualty Insurance), argued that the defendant purchased an insurance policy prior to the new law and therefore had a legal and binding contract with the insurance company to provide lifetime unlimited care as promised, including 24/7 attendant care. After hearings in the circuit and appellate courts, the case was presented before the Michigan Supreme Court. The Supreme Court opinion (due by July 31, 2023) will have a permanent impact on the future of Auto No Fault.
